General Terms and Conditions (GTC)
Redactwizard and Graymapper DICOM Research — B2B
Provider: Ünsal Genc Software
Effective date: 10/21/2026
These GTC apply exclusively to business customers, self-employed professionals, institutions and public-sector organizations acquiring the software for commercial, professional, institutional or official purposes. The products are not offered under these GTC for private consumer use. Mandatory statutory rights remain unaffected.
§ 1 Scope and Contract
- These GTC govern the purchase and use of Redactwizard and Graymapper DICOM Research, including the respective software editions, locally supplied AI models, components and documentation.
- The features and limitations specified in the applicable product description, offer and order confirmation determine the scope of the software supplied.
- The contract is concluded when the Provider accepts the customer's order, makes the software available or issues the license, whichever occurs first, unless the checkout process specifies another formation of contract.
- The customer confirms when ordering that the software is acquired for business, professional, institutional or official purposes.
§ 2 License and Permitted Use
- Upon full payment, the Provider grants the customer a non-exclusive, non-transferable and non-sublicensable right to use the purchased software version for an indefinite period, subject to these GTC and the applicable third-party licenses.
- The license is associated with the licensee identity supplied with the order, normally the purchaser's email address. For technical identification, this email address may be displayed in the application's “Organization” field. This field identifies the licensee and does not make the license freely transferable to other persons.
- The license is user-based, not device-based. An authorized user may use the software on multiple devices, provided that the number of individual persons using the software does not exceed the number of user licenses purchased. A multi-user license permits use by the number of users covered by the order. Sharing a single-user license between different persons is not permitted.
- The customer is responsible for ensuring that only authorized users access the software. The license key must be protected against unauthorized use and must not be published or supplied to unauthorized third parties.
- The customer may not rent, resell, sublicense, distribute or otherwise make the software available to unauthorized persons. Decompilation, reverse engineering or circumvention of technical protection measures is prohibited to the extent permitted by applicable law. Mandatory statutory rights remain unaffected.
- The customer does not acquire ownership of the software, source code, model weights or intellectual property rights. Third-party and open-source components remain subject to their respective license terms.
§ 3 Scope of Services, AI and Restrictions on Use
(1) Redactwizard provides document processing functions, including redaction and masking, pseudonymization, OCR and, where included in the purchased edition, AI-assisted processing and integrations with external services.
(2) Graymapper DICOM Research is intended exclusively for scientific research, teaching, education and technical evaluation purposes. The software enables the viewing and experimental processing of medical images and DICOM data, including the image analysis, OCR and anonymization functions available in the respective version. It is not intended for clinical use and is not offered as a medical device for the diagnosis, prevention, monitoring, prediction or treatment of diseases.
(3) Results produced by AI, OCR, redaction, pseudonymization, anonymization, image processing and document processing may be incomplete, inaccurate or incorrect. In particular, relevant text, metadata, identifying information or image content may be overlooked or processed incorrectly. The Provider does not guarantee that all relevant content will be detected, processed correctly or completely removed in every individual case.
(4) The software is a technical tool and does not replace independent professional or manual review. The user is responsible for appropriately reviewing processed documents, images, DICOM metadata and exported files before further use, disclosure or publication, and for validating the results for the relevant research, teaching or evaluation purpose.
(5) Clinical or patient-related use of Graymapper DICOM Research is expressly prohibited. In particular, the software must not be used for the diagnosis, early detection, monitoring, prediction or treatment of diseases, for deriving treatment decisions, or for otherwise supporting medical decisions concerning individual patients. The software and its outputs must not be used as a basis for the clinical care of patients. The Customer is required to use Graymapper exclusively within the intended purpose described in paragraph (2).
(6) Demo and trial versions are subject to the features, restrictions and terms of use stated on the respective product page or within the software. A demo or trial version does not grant a paid license and does not remove any existing technical restrictions.
§ 4 Local Processing and Third-Party Services
- The products' local core functions process data on the customer's system. In normal operation, customer documents, images and their contents are not automatically uploaded to the Provider's servers.
- Certain features explicitly selected by the customer, such as integrations with external AI services, APIs or other third-party services, may transmit selected prompts, documents or other data to the relevant provider.
- Before using such services, the customer is responsible for determining whether the intended data transfer and processing are lawful and permitted, including under applicable data protection, confidentiality and professional secrecy requirements. The third-party provider's own terms and privacy information apply.
- The customer is responsible for securing its systems, controlling access to processed data and maintaining appropriate backups.
§ 5 License-Related Identifiers
- Where implemented in the relevant product and export function, the software may embed a locally generated, license-related identifier in generated PDFs or other output files. Such an identifier is not the license key and does not constitute a digital signature or guarantee of document authenticity.
- The identifier is generated locally and is not automatically transmitted to the Provider during normal operation. If the Provider lawfully obtains an output file containing such an identifier, the Provider may compare the identifier with the internal license data necessary for this purpose, provided that there are specific indications of license misuse or unauthorized redistribution. Any such comparison shall be limited to what is necessary for that purpose. Personal data shall be processed only on an applicable legal basis and in accordance with applicable data protection laws. Further information regarding the purpose, legal basis and retention period of such processing is provided in the Provider’s Privacy Policy.
- The identifier does not technically prevent recipients from opening, viewing, printing, editing or copying an output. Further information about any associated personal data processing is provided in the Provider's privacy information.
§ 6 Prices, Delivery and Updates
- Prices and any applicable taxes are determined by the offer and checkout at the time of purchase. Payment is made using the methods offered during checkout. The Provider may withhold delivery of the license until the agreed payment has been received.
- The software is supplied digitally. The customer is responsible for meeting the stated system requirements and maintaining suitable backups.
- A one-time purchase does not include a subscription and does not automatically entitle the customer to future major versions, new features or ongoing support. Updates, fixes and support are provided as stated in the offer or as otherwise required by mandatory law.
- The customer should install applicable security updates promptly where they are made available.
§ 7 Customer Responsibilities
- The customer is responsible for ensuring that use of the software and processing of data complies with applicable law, including data protection, confidentiality, professional secrecy, copyright and other third-party rights.
- The customer must review processing results before relying on or disclosing them and must ensure that any required consent, authorization, legal basis or other permission exists.
- The customer must not use the software unlawfully or in a way that infringes third-party rights or enables unauthorized access to the software.
§ 8 Warranty and Defects
- Statutory warranty rights apply unless a valid agreement and mandatory law provide otherwise.
- Where § 377 of the German Commercial Code (HGB) applies, the customer must inspect the supplied software within a reasonable period, to the extent feasible in the ordinary course of business, and notify the Provider without undue delay of apparent defects. Hidden defects must be reported without undue delay after discovery.
- The Provider may remedy defects through correction or a replacement version where legally permissible.
- Differences in AI or OCR output that result from the described limitations of those technologies do not, by themselves, establish a defect. This does not exclude liability for a failure to meet expressly agreed contractual requirements.
§ 9 Liability
- The Provider is liable without limitation for intent, gross negligence, injury to life, body or health, liability under the German Product Liability Act, and any other liability that cannot be excluded or limited by law.
- In cases of slight negligence, the Provider is liable for breaches of material contractual obligations only for damage foreseeable and typical for the contract at the time of its conclusion. Material contractual obligations are those whose performance is essential to the proper performance of the contract and on whose fulfilment the customer may reasonably rely.
- Subject to paragraphs 1 and 2, liability for slight negligence is excluded to the extent legally permissible.
- To the extent legally permissible, liability for data loss is limited to the reasonable recovery costs that would have been incurred if appropriate, regular backups had been made.
- Nothing in these GTC excludes or limits liability or statutory rights that cannot lawfully be excluded or limited.
§ 10 Indemnification
To the extent permitted by law, the customer shall indemnify the Provider against third-party claims, including reasonable legal defense costs, insofar as those claims result from the customer's culpable unlawful use of the software or a material breach of these GTC. The Provider shall inform the customer promptly of such claims and allow reasonable cooperation in the defense.
§ 11 Term and Termination
- The usage right granted by a one-time purchase is for an indefinite period, subject to these GTC.
- Either party may terminate the contractual relationship for good cause where permitted by law. A material license violation may constitute good cause, depending on the circumstances. Where the violation can be remedied, the affected party should normally be given written notice and a reasonable opportunity to remedy it.
- Upon effective termination of the usage right, the customer must cease using the software and delete copies to the extent required by applicable law or the valid termination.
§ 12 Confidentiality and Data Protection
- Each party shall protect confidential information received from the other party against unauthorized disclosure and access.
- The local operation of the software does not, by itself, mean that the Provider processes customer content on the customer's behalf. Whether a data processing agreement or other data protection arrangement is required depends on the actual services and processing activities involved.
- The Provider's privacy information describes the processing of personal data associated with ordering, licensing, support and any other services provided by the Provider.
§ 13 Applicable Law and Jurisdiction
- These GTC and the contractual relationship are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
- Where the customer is a merchant, a legal entity under public law or a special fund under public law, the Provider's registered place of business shall be the place of jurisdiction to the extent permitted by law.
- Amendments and supplements must be made in text form unless mandatory law requires another form.
- If any provision of these GTC is invalid or unenforceable, the remaining provisions shall remain effective. The applicable statutory provisions shall apply in place of the invalid or unenforceable provision.
